Article 1 | Definition

1. Gropo Bouldergym is the trade name of the sports facility, which is operates at Ulgersmaweg 8 Groningen, Officially registered in Groningen and registered in de Dutch chamber of comers under number 65317513. Hereafter referred to as Gropo bouldergym.

2. Visitors within the meaning of these general terms and conditions are all natural persons who use the described facility.

3. Active visitors within the meaning of these general terms and conditions are visitors who make use of the sports facilities offered at Ulgersmaweg 8. Active visitors must be registered in the Gropo bouldergym registry before they can use the sports facilities.

Article 2 | Applicability and the formation of the agreement

1. Agreements are formed by the electronic registration of the active visitor in the registry of the Gropo bouldergym. The active visitor receives electronic confirmation of the registration.

2. The general terms and conditions, the house rules, and safety rules are applicable for each agreement between Gropo bouldergym and the active visitor. Gropo bouldergym can change the terms and conditions at any time.

3. The general terms and conditions, the house rules, and the safety rules apply for each visit and each participation of the active visitor at Gropo bouldergym.

4. Visitors are required to familiarise themselves with the general terms and conditions, house rules, and safety rules upon entering the sports facilities of Gropo bouldergym, which can be found on the website of Gropo bouldergym and in the direct vicinity of the front desk and climbing walls. If any of the terms and conditions, house rules or safety rules are unclear to the visitor or if the visitor is unsure about the manner in which to comply with the aforementioned rules and terms and conditions, the visitor is obligated to consult with the attending staff until the manner in which to comply is clear.

Article 3 | Safety

1. Active visitors can only participate in the sports activities on offer if they are in optimal health and sufficient physical fitness.

2. Active visitors have to take care of their own safety as well as the safety of those around them.

3. Active visitors cannot be under the influence of substances such as alcohol or drugs whilst doing the sports activities.

4. The active visitor takes part in the sports activities offered by the bouldergym completely at their own risk.

5. The safety rules are described in the house rules.

Article 4 | Admission

1. Every active visitor wishing to use the available sports facilities must register at the front desk upon their first visit, and thereby declares that they agree to the house and safety rules and the general terms and conditions and if required will be given a copy of the completed registration form.

2. Gropo bouldergym is entitled to ask visitors to make a reservation prior to his/her visit.

3. Every active visitor must report to the front desk prior to sports activities.

4. Children under the age of 7 are not permitted on the mats and/or the bouldering walls and can therefore not actively participate in sports activities at Gropo bouldergym.

5. Children aged 7 years only have access to the Gropo bouldergym youth training sessions. A parent must sign the registration form.

6. Active visitors aged 8 to 11 only have access to the bouldering facilities under the direct supervision of at least one adult visitor who signs the registration form on behalf of the 8 to 11 year old visitor. One adult can supervise maximum 1 child under the age of 10 or a maximum of 2 children age 10 to 11. They should move around the facilities as a group, whereby the adult has to stay in the direct vicinity of the children.

7. Active visitors from the age of 12 are permitted to participate in the sports activities on their own. Under the age of 16 years old a parent or a legal representative has to sign the registration form.

8. Every visitor must be able to provide identification.

9. Gropo bouldergym is entitled to independently determine the opening hours and limit the duration of visitors.

10. By entering our gym visitors from 16 years on agree to Gropo bouldergym making photo’s and video’s and using them on all their communication.

Article 5 | Conditions of membership

1. Gropo bouldergym membership grants access to Gropo bouldergym at a discounted membership rate.

2. All members receive a Gropo membership card or a QR code. This should be presented upon arrival at the location and when making purchases with Gropo membership discount.

3. A membership is started for a minimum period of 3 months. After this period the membership can be cancelled monthly with a 1 month notice period.

4. Gropo bouldergym membership starts when a member has filled in all the necessary information on the (online) registration form and paid the first membership instalment.

5. Gropo bouldergym uses your personal data in accordance with our privacy statement.

6. The first membership instalment is for the number of days remaining until the end of the first calendar month of the membership. This is to be paid online or at the front desk. Members subsequently pay a monthly membership fee per full calendar month.

7. The monthly membership fee will be collected without prior notice by direct debit (SEPA transaction). This takes place at the beginning of the month.

8. If the direct debit is not successful, Gropo bouldergym reserves the right to deny entry to the sports facilities of the bouldergym until the membership fee for the corresponding period has been paid in full.

9. Gropo bouldergym is at all times entitled to change the amount of the membership fee, including an annual inflation adjustment based on the CPI price index.

10. Membership can be cancelled at any time. It is followed by a cancellation period of 30 days.

11. Ill or injured? You can then pause your membership.

12. Gropo bouldergym reserves the right to terminate membership with immediate effect, without reimbursement of membership fees, if these general terms and conditions and house rules are not adhered to, as they are set out in this document which can be read in the bouldergym and on our website.

Article 6 | Cancellation policies

In the event of a cancellation or modification within 4 days before the booked activity, the Gropo bouldergym is entitled to charge the full amount of the original booking. This also applies to courses.

Article 7 | Removal and exclusion

1. Visitors who, in the opinion of the staff of Gropo bouldergym, fail to comply with the general terms and conditions and/or safety regulations and/or house rules and/or behave in such a way that this endangers order, concentration or safety, can be immediately removed from the premises.

2. In the event of repeat violations, Gropo bouldergym is entitled to exclude the visitor completely and indefinitely. The permanently removed or excluded visitor is not entitled to a refund of membership or admission fees.

3. Verbal or physical violence, intimidation and aggression against staff members and/or visitors of Gropo bouldergym will not be tolerated and will result in immediate exclusion.

4. Unwelcome harassment, sexual harassment and abuse (this is understood to mean any form of unwanted verbal, non-verbal or physical behaviour with a sexual connotation, the purpose or effect of which is to undermine the dignity of the person.) will not be tolerated and will lead to immediate exclusion.

5. The visitor is liable for any direct or indirect damages resulting from the actions mentioned in the clause above.

Article 8 | Liability

1. Gropo bouldergym is never liable for damages suffered by visitors as a result of theft, loss or vandalism in or around the premises. Gropo bouldergym is also never liable for damage to or inflicted by visitors (partly) as a result of diminished physical condition or health of the visitor or through defects and/or deficiencies in the visitors own bouldering equipment. 

2. Gropo bouldergym is never liable for damages of visitors resulting from violations of the general terms and conditions, house rules or safety regulations.

3. Except when training visitors, Gropo bouldergym members of staff are not responsible for any kind of supervision of the safety of the visitor, and as such Gropo bouldergym accepts no liability in this respect.

4. Gropo bouldergym accepts liability for damage or injury suffered by visitors that is the proven to result from a defect in the materials provided by Gropo bouldergym, except in the event that this material defect cannot be attributed to Gropo bouldergym.

5. In some cases Gropo bouldergym provides services in the form of instructions; Gropo bouldergym is not liable for any damage or injury resulting from actions or negligence of subordinates that are wholly or partially attributable to said subordinates, unless there is intent or gross negligence on the part of the subordinate.

6. Should Gropo bouldergym be liable on any grounds, said liability can only lead to compensation to the extent that liability is covered by Gropo bouldergym’s insurance policy and up to a maximum of the amount paid out by the insuring party. If the insurer of Gropo bouldergym notwithstanding the insurance coverage does not proceed with payment or if the insurer is not liable to payment on the grounds of an attributable shortcoming by Gropo bouldergym not covered by the insurance, the liability of Gropo bouldergym is limited to a maximum of € 10.000 per event.

7. The visitor is liable for damage caused to the building and inventory by said visitor personally.

Article 9 | Applicable Terms and Conditions

These General Terms and Conditions apply from the time of the date stated at the bottom, which coincides with the time of publication. Gropo bouldergym is entitled to change these general terms and conditions at any time. The new conditions will come into effect immediately after publication and they cannot affect the previously acquired rights of visitors, except in the case of renewed memberships and after the expiration of the membership.
